Terms & Conditions
"We" (including its various grammatical forms including the
possessive) or the "Web site" refers to KidsFurnishings.com.
"You" refers to the person accessing the Web site, or in the
event of a minor or other legally incompetent person, the person having
legal responsibility for such person. By using the KidsFurnishings.com
Web site, or accepting any benefits arising there from, you consent
to our terms and conditions and you become a party to this agreement
("Agreement"). The Agreement governs and controls your use
of the Web site, including, but not limited to all orders and purchases
you may make. If you do not consent to all the terms and conditions
and agree to become a party to the Agreement, without modification,
you are not authorized to use the Web site and you should leave immediately.
Changes to the Agreement shall be effective when made and published
on this site. Placing an order via telephone or online signifies acceptance
of our Terms and Conditions in full.
Information Accuracy :
We use reasonable efforts to include accurate and up-to-date information
on our Web site, but we make no warranties or representations as to
the accuracy of the information and accept no liability or responsibility
for any errors or omissions in the content of the Web site. Photographs
and color charts displayed on our site are for general information only
and can vary considerably from the actual color of the product. We do
not guarantee color, tone, shades or finishes on any item. If you are
trying to match items with other items you already have, you must do
so at your own risk. If a product is inadvertently listed at an incorrect
price, we may refuse to accept your order or may cancel your order at
any time. KidsFurnishings.com will contact you before proceeding with
your order to give you the option to pay the correct price or cancel.
A refund is your sole remedy for orders canceled by us.
Ordering
“ Acceptance” of an order (online or via telephone) is
provisional and it becomes final when we have verified price, availability,
and quantity. Item availability and price of products offered for sale
at the Web site are subject to change without notice, including the
updating of our online catalog. As soon as you place your order, we
begin the procurement process from your chosen furniture manufacturer.
Once we contact the manufacturer (usually within 48 hours of receiving
your order), we are unable to cancel or change that order without penalty
because once we have placed it at your request. KidsFurnishings.com
and you, our customer, each become obligated to complete the payment
of the purchase price. Once your order is accepted, we will then send
you a confirmation via email or facsimile. It is your responsibility
to review the order confirmation and advise us if there are any corrections
to be made in regard to delivery address, item, color or prices. If
no response is received within 48 hours, the order will be deemed accurate
and as you requested. If you do not receive a confirmation, you must
advise us and we will issue you another confirmation or copy. Orders
will be processed and are non-cancelable even if there is no response
after the confirmation has been sent. A signed confirmation must be
received before items are shipped. Payment of the full purchase price
must be made upon the acceptance of this agreement because of the one-of-a-kind
nature of your purchase and/or because of the discount involved, no
refund or replacement will be feasible should your selection prove unsatisfactory.
KidsFurnishings.com accepts MasterCard, Visa, Discover, American Express,
certified checks or money orders. At this time, we do not offer C.O.D.
terms. Certified checks and money orders by prior arrangement only.
Orders are subject to manufacturer approval. You will be notified as
soon as possible if an item or fabric is delayed or discontinued by
the manufacturer. This will not affect the remaining order. Defective
payments are subject to all charges, attorney fees and court costs allowed
by statute. Payment in US Dollars only.
Delivery Timeframes
We continuously strive to provide accurate estimates of delivery timeframes.
In an effort to expedite and shorten delivery times, we order your furniture
directly from the manufacturer's warehouse. We estimate 2 to 8 weeks
delivery time depending on which manufacturer(s) you choose. This means
delivery could be less than 2 weeks and it could be more than 8 weeks,
depending on availability, production schedules and weather. Please
keep in mind, while KidsFurnishings.com will do everything in it's power
to handle your order in an expedient manner, we have NO control over
how quickly a particular factory will fill your order and get the product
to our warehouse for delivery to you. As a general rule, KidsFurnishings.com
cannot promise a particular delivery date. If some items are delayed,
we can offer to "split ship" the order for you for a nominal
cost. We can estimate this cost for you at the time the request is made
by you.
We are happy to provide you with estimated delivery timeframes for all
items we offer; however these are only estimates. We have no control
over delivery schedule changes made by factories or over the accuracy
of information furnished to us by factories. We will deliver your furniture
as soon as it arrives at our warehouse.
Shipping and Handling; Taxes :
Product prices do not include shipping and handling (delivery charges),
these fees are collected at the time of order placement. Contract carriers
who are obligated to fulfill delivery of your order. They will contact
you prior to delivery, so as to establish an approximate time window
for you to receive your delivery. If no one is home to receive your
delivery, a repeat delivery charge will be incurred. Remote or inaccessible
delivery areas may be subject to surcharge or you may be required to
take delivery at a location acceptable to our contractors. Sales Tax
(currently 6.5%) will be charged on all items delivered to addresses
in the state of Florida. If use tax is charged by your state for items
purchased in another state, it is your responsibility to report and
pay any such taxes.
Curbside Delivery
Many of our items feature Curbside Delivery and are delivered via LTL
common carrier (trucking line). For Curbside Delivery orders, the common
carrier drivers will bring your purchase to your delivery address. The
driver will then take your purchase to the rear of the vehicle and you
will be responsible for unloading and bringing the item(s) into your
home. Due to the variety of sizes and weights of item(s), you may need
a couple of people to help unload item(s). Alternatively, most truck
freight companies offer additional services to help you move items from
the truck into your house if it is not included in your shipping charges.
You can work with the shipper directly to arrange for any additional
delivery services that you would like to take advantage of. You will
be responsible for directly paying the truck freight carrier for these
additional services. Drivers are expected to notify you of a delivery
time and day and your delivery service options, so you can have the
appropriate help available to get purchases into your home if necessary.
In-Home Delivery
Many items that we offer qualify for our in-Home Delivery service.
Items that are available with In-Home delivery will be noted as such
on our website. Items that are not noted as offering in-Home delivery
will be shipped by via our Curbside Delivery service (see above).
For our in-Home delivery, the delivery service will bring the furniture
inside the home and place it in the room of your choice. They will go
up or down a maximum of one flight of stairs. If they must go up or
down more than one flight, there will be an additional charge. The customer
is responsible to note the size and dimensions of the furniture you
order to make sure that it will fit not only in the designated room,
but also will go through the hallways, doorway, around corners, and
up or down stairs, etc. If the delivery to the designated room involves
potential damage to your home due to the weight or size of the furniture,
the delivery will be made to another area as designated by the customer.
If an item weighs over 300 pounds, the drivers will need assistance,
by an adult, on delivery. In the event the furniture does not fit into
the house or room, the delivery service will not return the merchandise
without an authorization from KidsFurnishings.com. Because we custom-ordered
the piece for you and cannot return it to the manufacturer, we must
charge a restocking fee of thirty five percent (35%) of your order plus
actual shipping charges. Mirror supports, center supports and bed slats,
unless specified, are not included with your furniture. You may request
these items, for a fee, from the delivery personnel. Delivery personnel
will not hang wall mirrors and will not assemble baby beds, "Ready
To Assemble (RTA)" furniture or accessory items, i.e. drawer knobs.
Please Note: Liability issues and time required prevent us from offering
assembly of baby beds, and Ready-to-Assemble furniture. We will still
inspect the product and place it in the room of your choice. Most deliveries
are schedule for Monday-Friday. Weekend deliveries are not available.
Since safety and environmental regulations prevent the carrier from
transporting the used packaging materials, delivery personnel will not
be responsible for taking back cartons or crates.
Delivery and Damage
All of our products are packaged with anticipation of some rough handling
during shipping. Some wear on packaging is normal. However, accidents
do happen; therefore, you MUST inspect your furniture when it is delivered.
If, at the time of delivery you notice any damage, defect or deficiency,
you MUST describe this on the Bill of Lading retained by the driver.
THIS IS VERY IMPORTANT. If you do not note damage at time of delivery,
the items will be deemed to have been delivered in good condition and
you will be responsible for the cost of any replacement parts plus shipping
cost. DO NOT REFUSE THE SHIPMENT. If you do not properly report the
damage, defect or deficiency at the time of delivery, we will not be
able to assist with later claims. A re-delivery charge will be incurred.
If the delivery personnel can correct the problem, it will be taken
care of immediately. If not, the shipper will return the item for repair
or replacement, at our discretion and then be redelivered to you. You
will not be charged for this redelivery unless the merchandise was of
normal production quality. Customer agrees to accept delivery appointment
for any backorders, repairs or replacement furniture to complete the
order process. Orders refused for delivery after 30 days will be subject
to storage fees of a minimum of $50.00 charge per month or $10.00 per
100 lbs.
Cancellations/Returns
Furniture Orders
As soon as you place your order, we begin the procurement process from
your chosen furniture manufacturer. Once we contact the manufacturer
(usually within 48 hours of receiving your order), we are unable to
cancel or change that order without penalty because once we have placed
it at your request. KidsFurnishings.com and you, our customer, each
become obligated to complete the payment of the purchase price. (a)
For that reason, we are unable to accept cancellations, in either whole
or part, once the order is placed. Because we custom-ordered the piece
for you and cannot return it to the manufacturer, we must charge a cancellation
fee of thirty five percent (35%) of your order, or portion of an order
cancelled plus actual shipping charges, if a cancellation is permitted.
This fee helps to defer the product cost and freight charges. (b) When
your furniture is ready for shipment, you will be notified to schedule
delivery appointment. If you refuse the delivery appointment of your
furniture, this will be treated as an unauthorized cancellation of your
order, subject to a cancellation fee of 35% of your order plus actual
shipping charges. This fee helps to defer the product cost and freight
charges. (c) If merchandise is damaged or defective, we will arrange
repair or replacement, in our sole discretion, of products, which do
not conform to the manufacturer's specifications. Furniture may be repaired
in your home or may be returned for repair. Customer agrees to accept
delivery appointment for any backorders, repairs, pick-ups or replacement
furniture to complete the order process. Returns may be authorized pursuant
to paragraph 3(a) only. No merchandise may be directly returned to KidsFurnishings.com
under any circumstances. In the event merchandise is to be picked up,
customer agrees to allow up to 10 business days for pick-up appointment.
All merchandise to be picked up MUST be in the original packaging and
sealed. Customer will be responsible for packaging merchandise in the
event original packaging is not available or was discarded by customer.
Items being packaged by customer must be packaged in a manner suitable
for transprt (ie. in carton, corrugated, fully enclosed and sealed).
Customer may be responsible for damages incurred during transit if not
packaged according to KidsFurnishings.com guidelines.
Accessory Orders
Orders placed for such items as comforters, lamps, tables and chair
sets, bean bags and other small accessory items that are shippable via
UPS or FedEx may be canceled within 48 hours of order placement with
no penalty. Outside of the 48 hours, orders may be canceled if the item
has not shipped. A 15% cancellation fee will be applied to the refund
because we have committed to purchase this item from your chosen manufacturer
and can not cancel the order placed with them. This cancellation fee
is used to defray product cost and shipping cost.
If you wish to return an accessory item, you must first obtain a return
authorization from KidsFurnishings.com and print it boldly and legibly
on the outside of the package. Merchandise sent to KidsFurnishings.com
without a return authorization written on the outside of the package
will be refused. All items to be returned must be in their original
packaging and shipped within 7 (seven) days of receipt of merchandise
by you,**THIS ONLY APPLIES TO ACCESSORY ORDERS**. Once we receive your
authorized accessory return, we will refund your purchase amount minus
a 15% re-stocking fee and original shipping cost within 15 business
days. Merchandise sent as postage due will be refused.
Warehouse Pickup
You may chose to pickup your purchase at our warehouse in North Carolina
or Lakeland, Florida. You will need to provide 48 hours advance notice
so that we may inspect and prepare your order for pickup. We will notify
you when your order is ready for pickup and give you the phone number
of the delivery company (for North Carolina pickups) at that time so
you can arrange your pickup appointment. We recommend that you carefully
inspect the merchandise before we release it to you. Any damage or defects
are the responsibility of the customer after KidsFurnishings.com releases
the merchandise. Fees that apply for a North Carolina pickup: (a) $25.00
per item pick-up fee, (b) $15.00 notification fee, (c) Any inbound freight
charges. Mirror supports, center supports and bed slats, unless specified,
are not included with your furniture. You may request these items, for
a fee, from the delivery company. Please note the KidsFurnishings.com
warehouse location is not a store or showroom.
Limited Time Offers and Special Promotions
All sales, special offers, and limited time promotions are available
for appointed time periods only. They cannot and will not be applied
to sales closed before or after such time periods.
International Shipments
KidsFurnishings.com does offer overseas deliveries (including Alaska,
Hawaii and international orders); however, our overseas delivery only
includes shipping your items to the nearest U.S. port and is explicitly
limited to "as is" condition. The customer is responsible
for making arrangements to get the merchandise from that port to its
final destination.
Manufacturer's Warranties
A warranty, If any, is the warranty provided by the manufacturer, which
is generally limited to defects in materials and workmanship. Variations
in wood grain, knots, texture, open knots and grain, color variation,
panel shifting, random patterns, bleeding, dark end grain and other
natural occurring characteristics of wood are not considered defects.
All of these are part of the natural beauty that is real wood furniture.

please consult a member of our staff. In many cases more than one material
type is available for the same item. A copy of a particular product's
warranty is available from us upon request and may be included with
your order.
